Advanced Medical Torts CLE: Stacy Garcia asked to Speak

What Are Periodic Payments?

Periodic payments allow courts to structure future damage awards—particularly those exceeding $100,000—into scheduled payments over time, rather than a single lump sum. This approach can:

  • Reduce the immediate financial burden on healthcare providers,

  • Ensure long-term compensation for plaintiffs, and

  • Prevent overcompensation in the event of premature death.

However, as Garcia emphasized in her presentation, these cases are highly technical and require:

  • Timely notice and pleading,

  • Expert testimony on life care planning and annuity structures,

  • Detailed financial disclosures, and

  • Strict adherence to statutory and case law requirements, including recent guidance from the Texas Supreme Court in Regent CareColumbia Valley, and Virlar.
